GENERAL TERMS OF SALES FOR INDIVIDUALS - ONLINE & REMOTE SALES
The present general terms of sale are accepted by the company HORSE PILOT with a registered capital of 177,490 euros, the head office of which is based in CYSOING (FRANCE), registered in the Trade & Company Register of Marseille under the number 527 876 445 hereafter referred to as “HORSE PILOT” and by any natural or artificial person wishing to make a purchase via the “HORSE PILOT” website, hereafter referred to as the “purchaser”.
Purpose
The present general terms of sale define the contractual relationship between HORSE PILOT and the purchaser, and the conditions applicable to any purchase made via the HORSE PILOT sales website, whether the purchaser is a trade client or a consumer. The acquisition of a product or service via the present website implies unreserved acceptance of these general terms of sale by the purchaser.
These terms of sale take precedence over any other general or special terms which have not expressly been approved by HORSE PILOT. HORSE PILOT reserves the right to modify its terms of sale at any time. In this case, the applicable terms will be those in force on the date the order is placed by the purchaser.
The characteristics of the products proposed for sale
The products proposed for sale are those presented on the HORSE PILOT website. These products are proposed subject to available stocks.
The photographs featured on the website are as faithful as possible but cannot be considered as guaranteeing a perfect representation of the product on sale, including with regard to colours.
Prices
The prices listed on the site are prices including VAT in euros (or in the currency of the country selected: US dollars, CA dollars, AUS dollars, NZD dollars, British Pound, Swiss Franc, Danish Crown, Norwegian Crown, Swedish Crown, Japanese Yen... ) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may result in a modification to the prices of the products or services. HORSE PILOT reserves the right to modify its prices at any time, with it however being understood that the price shown in the catalogue on the order date will be the only price applicable to the purchaser. The prices shown include order processing, transportation and delivery costs on condition that delivery is to one of the geographical zones detailed hereafter.
Orders
A purchaser wishing to purchase a product must obligatorily:
Complete the information form, supplying all the requested details;
Confirm his order after having checked it;
Proceed with payment in accordance with the stipulated conditions;
Confirm his order and his payment. The confirmation of the order will automatically constitute acceptance of the present general terms of sale, including acknowledgement that the purchaser has fully familiarized himself with them and a renunciation of his right to avail himself of his own general purchasing terms or other conditions. All the data supplied and the recorded confirmation constitute proof of the transaction. The confirmation is considered equivalent to the signature and acceptance of the operations performed. The vendor will send a confirmation of the booked order by e-mail.
Retraction
When the purchaser is a natural person and a non-trade client, he will have a 30-day retraction period following the delivery date of his order to return the product to the vendor and to obtain an exchange or refund without penalty. Products returned or exchanged must be new and in their original packaging.
For custom products, produced at the specific request of the client such as a customizable competition jacket, the client has a period of thirty days to report any size-related problem and to request that the item be exchanged for a different size. The colours, models and finishes on the jacket cannot be modified when requesting this change of size. No refund will be possible in as far as the manufactured product is produced at the specific request of the client.

The return costs and the reshipment costs will be borne by Horse Pilot for Europe area. The return costs and the reshipment costs will be borne by the client for non-Europe area.
Commercial operation
It is specified that during a period of temporary commercial operation (promotions, sales, BOX, etc.) HORSE PILOT may apply special conditions. The latter may then change the delivery times (due to the large number of orders, delivery times may vary from 2 to 5 working days) or the return method, which may exceptionally be at the customer's expense or still the products can be neither exchangeable, nor refundable. If these special conditions are changed during the said commercial transactions, they are then specifically posted on the product page of the website near the "add to cart" button.
Payment terms
The full asking price is payable at the time the order is placed.
Payments must be made by:
Bank transfer (our bank details necessary for the cash transfer will be provided to you at the time your order is confirmed)
Bank card via 3D Secure:
PAYPAL - the precise list of accepted credit cards is shown to the customer during the payment process. If the customer has a PAYPAL account, he can connect to it and make the payment directly. Depending on your country, PAYPAL offers you the possibility to pay in several instalments without any fees.
KLARNA (via Stripe) - By paying in 3 free installments, you split the cost of your purchase into 3 equal installments. Each installment will be collected automatically from the credit or debit card provided at the time of payment for your online purchases.
APPLE PAY - Apple payment system (via your Macbook, iMac, iPhone or iPad...)
STRIPE - the precise list of accepted credit cards is notified to the customer during the payment process.
Gift vouchers or promotional coupons purchased online via our website are non-refundable.
HORSE PILOT uses the SSL protocol (Secure Socket Layer) resulting in the information being encrypted using software, with no third-party able to consult this information during transit through the network.
The purchaser’s account will only be debited for the cost of the ordered products at the time the client confirmed his order. At the purchaser’s request, we can send him a paper invoice detailing the VAT paid.

Am I eligible to use the payment method in 3 times without expenses ?
To pay in 3 installments without charge with Klarna on our site, you must be at least 18 years old and spend a minimum of €35. Although the "Pay later in 3 instalments with Klarna" option is available to many people, the possibility of paying in 3 instalments without charge will depend on your financial situation.
What information do I need to provide when shopping?
If you wish to make online purchases by paying in 3 times free with Klarna, you will need to provide your cell phone number, email address, current billing address and credit card details. The phone number is required in case Klarna or our team needs to contact you. All communications from Klarna will be sent to your email address. It is essential that you provide the correct information to ensure that you receive details of your payment schedule, as well as any information regarding the processing of your order.
What are my payment options with Klarna?

What happens if I cancel my order or request a refund?
Once Horse Pilot accepts your cancellation/return, Klarna will cancel any future scheduled payments and refund any payments already made for that order. This refund will appear on the Klarna app immediately.
What happens if I don't pay for my order?
Klarna will automatically attempt to charge the amount due associated with your purchase with the "Pay Later in 3 Installments with Klarna" option on the Horse Pilot website to the credit or debit card listed at the time of checkout. If Klarna is unable to collect payment by the scheduled date, a second direct debit attempt will be made two days later. If this second attempt fails, Klarna will send you a statement for the full amount due, payable 15 days later. Klarna will send you a notification when a payment is due 2 days before the direct debit attempt; also, you can track your next payment due date at any time on the Klarna app. Using the "Pay Later in 3 Installments with Klarna" option does not affect your credit score, even if you have not made your payment on the scheduled due dates.
Deliveries/ Packaging
Delivery will be made to the address shown on the order form which may only be located within the agreed geographical area. All risks will be borne by the purchaser from the moment the products leave HORSE PILOT’s premises.
In the event of any losses or damage during transportation, objections accompanied by full explanations must be submitted to the haulier within a period of three days following delivery. Delivery dates and lead times are provided for information purposes only: if these exceed 30 days as from the date of the order, the contract of sale may be cancelled and the purchaser reimbursed.
The products are shipped in a suitable carton wrapped in plastic film. The customizable competition jackets are shipping in a Horse Pilot protective cover.
Warranty
All products supplied by the vendor are covered by the legal warranty provided for in articles 1641 and following of the French Civil Code. In the event that a product sold is found to be non-compliant, this may be returned to the vendor who will issue an exchange or refund. All claims and all requests for exchanges or refunds must be submitted by post to the following address: Horse Pilot – 450 rue de Gruson - 59830 Cysoing FRANCE within a period of 30 days following the delivery date.
Airbag Maintenance
Maintenance of the Airbag Product is recommended every two years. This service, for which a charge is made, consists of a visual inspection of the various components of the Product, a check of the triggering mechanism and a pressurization of the airbag module.
The refill/cartridge is not replaced; the Customer is reminded, when ordering maintenance, that a replacement refill/cartridge must be ordered separately if necessary. Maintenance does not extend the warranty (legal or commercial) of the Product.
Shipping and return costs are at the Customer's expense. The maintenance period may vary from a few days to a few weeks if the maintenance involves a repair that has been previously authorized by the Customer through validation of a quote.
Liability
During the online sales process, the vendor is bound only by an obligation of due care. He may not be considered liable for any losses resulting from the use of the Internet network such as a loss of data, intrusions, viruses, service outages or other involuntary problems.
Intellectual property rights
All features and components of the HORSE PILOT website are (and will remain) the exclusive intellectual property of HORSE PILOT.
No one is authorized to reproduce, exploit, broadcast, recirculate or use in any way whatsoever (even partially) the components of the website whether these are in software, visual or audio form. Any simple or hypertext link is strictly forbidden without the express written agreement of HORSE PILOT.
Personal data
In compliance with the French Data Protection Act of January 6, 1978, information of a personal nature concerning the purchasers may be the subject of automated processing. HORSE PILOT reserves the right to collect information concerning the purchasers including through the use of cookies and, if it so wishes, to forward the said information to business partners.
Purchasers may oppose the divulgence of their contact details by informing HORSE PILOT of this. Similarly, users have a right to access and rectify any data concerning them in compliance with the law of January 6, 1978.
Archiving / Proof
HORSE PILOT will archive the order forms and invoices on a reliable and durable medium constituting a true copy in compliance with the terms of article 1348 of the French Civil Code. HORSE PILOT’s computer logs will be considered by the parties as constituting proof of communications, orders, payments and transactions between the parties.
Dispute resolution
The present online terms of sale are subject to French law. In the event of litigation, legal competence is attributed to the competent courts of Marseille notwithstanding multiple defendants or the introduction of third parties.
